Our preliminary analysis of Bill C-2 situates the legislation within the context of existing research by the Citizen Lab about two potential data-sharing treaties that are most relevant to the new proposed powers being introduced in Bill C-2: the Second Additional Protocol to the Budapest Convention (2AP) and the CLOUD Act. Both of which carry significant constitutional and human rights risks.

Legal researchers Cynthia Khoo and Kate Robertson warn that a Canada-U.S. CLOUD agreement would extend the reach of U.S. law enforcement into Canada’s digital terrain to an unprecedented extent, and that if signed, this agreement would effectively allow U.S. police to demand personal data directly from any provider of an “electronic communication service” or “remote computing service” in Canada, so long as it had some ties to the U.S.

In this report, we undertake a preliminary comparative analysis of how different information technologies were mobilized in response to COVID-19 to collect data, the extent to which Canadian laws impeded the response to COVID-19, and the potential consequences of reforming data protection or privacy laws to enable more expansive data collection, use, or disclosure of personal information in future health emergencies.

This report presents results from a series of research projects that measured responses to personal data requests from telecommunication companies and Internet Service Providers across jurisdictions in Asia including Australia, Hong Kong, South Korea, Indonesia, and Malaysia. Overall, the projects found responses from telecoms were incomplete and in some cases did not follow what is required by law.

The proposed rationales for weakening encryption would exchange marginal gains in limited investigative situations for significant loses with regards to Canadians’ abilities to exercise their rights and freedoms while simultaneously undermining cybersecurity, economic development, and foreign affairs. Minister Goodale should stop calling persons with well-considered policy positions on the importance of enabling the availability of strong encryption as supporters of child abusers, and get on with his job of trying to keep Canadians safe instead of endangering them with his irresponsible and dangerous encryption policy.
